Welcome to National Youth Computer Academy (NYCA). By accessing or using our website of services, you agree to comply with and be bound by the following Terms & Conditions. These terms apply to all users, including students, franchise owners, and business partners. Please read these terms carefully before enrolling or engaging with our services.
1. General Terms
- NYCA offers offline training at its campus. All admissions are currently open only for offline training. In the future, we may introduce online training and admissions, and updated terms will be applicable at that time.
- By enrolling as a student, becoming a franchise partner, or collaborating with NYCA, you agree to adhere to the policies, rules, and regulations set forth by the institution.
- NYCA reserves the right to modify, update, or change any part of these terms at any time. Any changes will be communicated through appropriate channels.
2. For Students
- Admission Process: Admission to any course at NYCA is subject to availability, eligibility criteria, and payment of prescribed fees.
- Course Duration: Course duration and schedules are defined by NYCA, and may be subject to change due to unforeseen circumstances or operational needs.
- Fees & Payments: All course fees are to be paid in advance as per the prescribed schedule. Failure to pay on time may result in suspension or cancellation of your enrollment.
- Refund Policy: Once enrolled, no refunds will be provided for any fees, unless specified otherwise in specific cases such as a course being canceled by the institute.
- Behavior & Conduct: Students are expected to maintain discipline and respect within the campus. Any form of harassment, violence, or disruptive behavior will result in immediate expulsion from the institution.
- Certificates & Awards: Certification will be awarded based on the completion of course requirements. Students must meet the required attendance and assessment criteria.
3. For Franchise Owners
- Franchise Agreement: Franchise owners are required to sign a formal agreement outlining the terms and conditions of their franchise relationship with NYCA. This includes financial obligations, marketing guidelines, and operational standards.
- Training & Support: Franchise owners will receive training and support from NYCA to ensure adherence to our standards. Any violation of the terms will lead to penalties or termination of the franchise agreement.
- Use of NYCA Branding: Franchisees are allowed to use the NYCA brand only as per the terms of the agreement. Unauthorized use or modification of the branding is prohibited.
- Termination of Franchise: NYCA reserves the right to terminate any franchise agreement if the franchisee fails to comply with operational, financial, or ethical standards.
4. For Business Partners
- Business Collaboration: Business partners entering into collaboration with NYCA must sign an agreement specifying the terms of the partnership, including roles, responsibilities, and financial arrangements.
- Intellectual Property: All intellectual property, including course content, logos, and materials, remains the exclusive property of NYCA. Business partners may not use, distribute, or modify such property without prior written consent from NYCA.
- Confidentiality: Business partners must maintain confidentiality regarding all proprietary information shared by NYCA, both during and after the partnership period.
5. Limitation of Liability
- NYCA is not responsible for any loss or damage incurred by students, franchise owners, or business partners in connection with their participation in NYCA’s programs or partnerships, unless caused by negligence or breach of contract by NYCA.
- Under no circumstances will NYCA be liable for indirect, incidental, or consequential damages.
6. Indemnification
- Students, franchise owners, and business partners agree to indemnify and hold NYCA harmless from any and all claims, damages, liabilities, and expenses arising from their participation in NYCA’s services, courses, or partnerships.
7. Privacy and Data Protection
- NYCA collects and processes personal data in accordance with applicable data protection laws. This data is used for operational purposes, including but not limited to course management, student records, and communication.
- By using our services, you consent to the collection and use of your personal data as described in our Privacy Policy.

8. Governing Law and Dispute Resolution
- These Terms & Conditions shall be governed by and construed in accordance with the laws of India.
- Any disputes arising from these terms will be resolved through mediation or arbitration, as deemed appropriate by NYCA.
9. Changes to Terms & Conditions
- NYCA reserves the right to update, amend, or modify these Terms & Conditions at any time. Changes will be effective immediately upon being posted on the website or communicated through other channels.
- It is the responsibility of the students, franchise owners, and business partners to review the Terms & Conditions regularly to stay informed of any updates.
10. Force Majeure
- NYCA will not be held liable for any failure or delay in the performance of its obligations due to unforeseen events such as natural disasters, strikes, war, government restrictions, or any other events beyond its control.
- In such cases, NYCA will make reasonable efforts to mitigate the impact and resume normal operations as soon as possible.
11. Dispute Resolution and Jurisdiction
- In the event of any dispute arising from these Terms & Conditions or related matters, both parties agree to attempt to resolve the issue amicably through direct communication.
- If a resolution cannot be reached, the dispute will be settled through arbitration under the Arbitration and Conciliation Act of India. The place of arbitration will be at the discretion of NYCA, and the language of arbitration will be English.
- The jurisdiction for all legal proceedings will be the courts in Kolkata of West Bengal, India.
12. Severability
- If any provision of these Terms & Conditions is deemed invalid, illegal, or unenforceable by any court of law, the validity of the remaining provisions will not be affected, and the only invalid provision will be amended to reflect the intent of the parties.
13. Acknowledgment
- By using NYCA’s services, enrolling in courses, or engaging with us as a franchise or business partner, you acknowledge and accept these Terms & Conditions and agree to be legally bound by them.
- Students, franchise owners, and business partners must agree to these Terms & Conditions prior to registration or participation in any of NYCA’s programs or offerings.
14. Use of NYCA’s Website
- The NYCA website (https://nyca.online) is provided for informational and educational purposes only. Accessing or using the website does not constitute an agreement to enroll in any of our programs or services.
- All users agree to use the website in accordance with applicable laws and to refrain from any activity that could harm the reputation, operation, or functionality of the site.
- NYCA reserves the right to modify or restrict access to its website at any time without notice.
15. Student Support Services
- NYCA offers student support services to assist with course-related queries and issues. However, we do not guarantee immediate resolutions for all concerns.
- Students are expected to raise any issues through the appropriate channels and provide necessary documentation or information when requested. NYCA will do its best to resolve issues in a timely and efficient manner.
16. Social Media and Marketing
- Students, franchise owners, and business partners grant NYCA permission to use their name, image, and testimonial for promotional purposes, including on our website, social media platforms, and in marketing materials, unless otherwise specified in writing.
- All promotional activities conducted by franchise owners or business partners must align with NYCA’s branding guidelines and be approved by NYCA prior to release.
17. Intellectual Property and Ownership
- All content provided by NYCA, including course materials, logos, images, and videos, is protected by copyright, trademark, and other intellectual property laws. Unauthorized use or reproduction of any content is strictly prohibited.
- Students and business partners are granted a limited, non-transferable license to use course materials solely for educational purposes. Redistribution or commercial use of any NYCA content is prohibited without prior written consent.
18. Student Responsibilities
- Students are responsible for attending classes as per the scheduled dates and times. Non-attendance or lack of participation may result in disqualification from receiving certification.
- Students are required to complete all assessments and assignments as part of the course requirements.
- NYCA is not responsible for students’ external personal or professional obligations that might affect course progress or performance.
19. External Links
- NYCA’s website may contain links to third-party websites for your convenience or information. We do not control, endorse, or take responsibility for the content or practices of these third-party websites. Accessing such links is done at your own risk.
20. Miscellaneous
- These Terms & Conditions constitute the entire agreement between NYCA and the user. Any previous agreements, understandings, or representations are superseded by these terms.
- No waiver of any provision of these Terms & Conditions will be deemed a waiver of any subsequent breach or default of the same provision.
21. Placement and Job Assistance
- Placement Support (Not Guaranteed): NYCA provides placement only assistance to eligible students who successfully complete their course. However, NYCA does not guarantee job placement or employment in any form. Placement opportunities depend on industry demand, student skills, and employer requirements.
- Franchise owners may offer local job placement assistance under NYCA’s guidelines but must not guarantee jobs falsely in marketing materials.
- Business partners providing job placement services in collaboration with NYCA must adhere to legal and ethical hiring practices.
- NYCA does not influence employer decisions regarding hiring, salary, or job roles.
- Students must independently clear employer interviews, tests, and selection procedures.
- Once a student is placed, NYCA is not responsible for disputes regarding salary, work environment, or contract terms with the employer.
22. Code of Conduct and Disciplinary Actions
General Conduct:
- All students, franchise owners, and business partners must maintain professionalism and ethical behavior within NYCA premises and in all institute-related activities.
- Any form of harassment, discrimination, abusive language, or violence against staff, students, or business partners will lead to immediate termination of enrollment or contract.
- The use of alcohol, drugs, or any illegal substances within the institute premises is strictly prohibited.
Misuse of NYCA’s Name and Resources:
- Students, franchise owners, or business partners must not misuse NYCA’s brand, logo, or credentials for personal or commercial gain without written permission.
- Fraudulent claims about NYCA’s courses, placements, or partnerships will result in legal action.
Disciplinary Actions:
- NYCA reserves the right to suspend or expel students or terminate contracts with franchise owners and business partners for:
- Any misconduct affecting the reputation or operations of NYCA.
- Engaging in fraudulent activities related to admissions, placements, or financial transactions.

Student Termination:
- NYCA reserves the right to terminate student enrollment due to:
- Non-payment of fees.
- Violation of discipline, academic dishonesty, or misconduct.
- Breach of policies related to attendance, plagiarism, or harassment.
- Terminated students are not eligible for a refund under any circumstances.

Franchise and Business Partner Termination:
- NYCA may terminate agreements with franchise owners or business partners for:
- Breach of contract or non-compliance with NYCA’s operational guidelines.
- False promises made to students or misuse of NYCA’s name.
- Failure to meet performance benchmarks as per the franchise agreement.
- Upon termination, all NYCA branding, materials, and intellectual property must be returned or removed immediately.

Refund Policy:
- No refund will be provided once the admission or franchise fee is paid, except under special circumstances as decided by NYCA’s management.
- If a course is canceled by NYCA, students will be given the option to enroll in another batch or receive a partial refund (if applicable).

24. Confidentiality and Data Privacy
Student & Franchise Data Protection:
- NYCA ensures that personal data of students, franchise owners, and business partners is kept confidential and used solely for operational and communication purposes.
- Data will not be shared with third parties without explicit consent, except as required by law.
Usage of Student & Business Partner Information:
- By enrolling in NYCA or signing a business agreement, individuals consent to NYCA using their data for communication, training, and promotional activities.
- Students can opt-out of marketing communications upon request.
25. Future Online Training and Admissions
- NYCA currently offers only offline training and admissions.
- In the future, online training and admissions may be introduced. When this happens, new terms and conditions specific to online learning will be added.
- Students enrolling for online courses in the future must agree to additional terms related to digital learning, assessments, and online support.
